Guest Terms and Conditions of the Property

1. The property is offered for holiday rental subject to confirmation by the owners to the renter.

2. A deposit of £150 is required at the time of booking which is used as a guarantee against any damage caused to the property during the stay. Once the deposit has been paid you are agreeing to the terms and conditions on this page.

3. The balance of the rent is payable 8 weeks before the start of the rental period. If the booking is made last minute we will require full payment. The £150 refundable security deposit must be paid by cash or by cheque in addition to the balance. This is held by the Owners against loss or damage to the property by the parties to this agreement. The deposit will be fully refunded within 2 week of departure once our onsite representatives have made a full check of the property. If full payment is not received by the due date, the owners reserve the right to give notice in writing that the reservation is cancelled. The Client will remain liable to pay the balance of the rent unless the owners are able to re-let the Property.

4. Any chargeable expenses arising during the rental period will be invoiced separately.

5. In the event of a cancellation, refunds of amounts paid will be made if the owners are able to re-let the "Property", and any expenses or losses incurred in so doing will be deducted from the refundable amount. Should you wish to cancel, written notification must be sent from the party leader to our email address ( it is also advisable to contact us by phone).
In the event of cancellation, the following charges apply:

Period before arrival date that letter is received

More than 8 weeks =        Deposit only
less than 6 week  =        50%
Between 2 – 4 weeks =     60%
Between 1- 2 weeks        100%

6. Should you wish to make any changes to your confirmed booking, you must notify us by email as soon as possible. Whilst we will endeavor to assist, we cannot guarantee we will be able to meet any such requests. Where we can, an amendment fee may be payable together with any costs incurred by ourselves.
Occasionally, we have to make changes to and correct errors on our web site descriptions and other details both before and after bookings have been confirmed and cancel confirmed bookings. Whilst we always endeavor to avoid changes and cancellations, we must reserve the right to do so. If we have to make a significant change to or cancel your booking, we will tell you as soon as occur. We regret we cannot pay any expenses, costs or losses incurred by you as a result of any change or cancellation

7. The Client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party's personal belongings, public liability etc, since these are not covered by the owners insurance. You are also advised to obtain from the Post Office Form E111 which enables UK residents to obtain emergency medical treatment in Spain, as our local representative and/or the owner accept no liability for personal injury during the rental period.

8. The accommodation is from Start Date to End Date.
The rental period shall commence at 2:00pm on the first day and finish at 11:00am on the last day unless otherwise agreed. The Agent or owners shall not be obliged to offer the accommodation before the time stated and the Client shall not be entitled to remain in occupation after the time stated.
9. The maximum number to reside in the "Property" must not exceed the stated property occupancy.

10. The Client agrees to be a considerate tenant and to take good care of the "Property" and to leave it in a clean and tidy condition at the end of the rental period. A charge is made for cleaning and laundry for each booking and this is payable with the rental charge. The owners reserve the right to charge for additional cleaning costs if the client leaves the "property" in an unacceptable condition. The Client also agrees not to act in any way which would cause disturbance to those resident in neighboring properties. We also have a non smoking policy within the property.

11. The Client shall report to the owner's agent, without delay, any defects in the "Property" or breakdown in the equipment or appliances in the "Property", and arrangements for repair and/or replacement will be made as soon as possible.

12. The property will be cleaned prior to your arrival and after your departure. Although the property will be cleaned after your departure, it must be left in an orderly state and all kitchen utensils must be washed and BBQ in the property fully cleaned. Should the property require extensive cleaning or crockery/utensil washing then the Owners reserves the right to withhold any monies from the security deposit to pay for the extra cleaning.

13. If you lock yourself out of the property there will be a call out charge of 25 Euro. If we are unable to gain entrance into the property due to keys being left inside the lock we may need to call out a locksmith and all charges will be passed on to the renter. If you are unfortunate enough to lose the property keys during the rental period you might be charged 50 Euro.

14. Our onsite representative and/or the owners shall not be liable to the client:
a) for any temporary defect or stoppage in the supply of public services to the "Property", nor in respect of any equipment or appliances in the "Property", garden or swimming pool.
b) for any loss, damage or personal injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the owners.
c) for any loss, damage or inconvenience caused to or suffered by the Client if the "Property" shall be destroyed or substantially damaged before the start of the rental period and in any such event, the owners shall, within seven days of notification to the Client, refund to the Client all sums previously paid in respect of the rental period.
d) The guest is hereby made aware that on many complex´s there will be other homes/apartments under construction. Our Agents and/or the owner will not accept liability for any complaints arising from construction.
e) Our onsite representative and/or the owner will not be liable for any loss due to noise or disturbance from anywhere within the vicinity of the property.

15. Under no circumstances shall the owners' liability to the Client exceed the amount paid to the owners for the rental period.

16. The property is to be occupied only by the party on the booking form.

17. If, in the opinion of the owners or their agents, any of the party are guilty of conduct prejudicial to the property or are in breach of the law, or cause a serious disturbance, the owners or their agent may take re-possession of the property without notice or refund to the client.

18. All vehicles are parked on the property at the client's own risk.

19.The property has a shared swimming pool, which should be open all year round, however the owners and their agent's, do not accept liability should it be closed or for injury howsoever caused as a result of misuse of the pool or the pool area. Guests are specially requested NOT to allow unsupervised children under 12 to use the pool or the pool area.
20. A cot, bedding and high chair can be provided in the property for a local charge - please request this at time of booking so advance arrangements can be made as we have a limited amount. This equipment is checked by our onsite representative on a regular basis and any damage caused whilst on loan will result in the client's security deposit being retained. Responsibility of the equipment and its correct use following guidance and instructions given is that of the customer. Our Agents will not be liable for accidents incurred during the rental of any equipment. Children should be supervised at all times when using equipment etc.

21. No pets are allowed at the property.

22. In the unlikely event that you have any reason to complain or experience any problems with your stay whilst away, you must immediately inform us. Any verbal notification must be put in writing and given to us as soon as possible. Until we know about a problem or complaint, we cannot begin to resolve it. Most problems can be dealt with quickly. For all complaints and claims which do not involve death, personal injury or illness, we regret we cannot accept liability if you fail to notify the complaint or claim entirely in accordance with this clause.

23. If you have any special request, you must advise us prior to making any booking. Although we will endeavor to meet any reasonable requests we regret we cannot guarantee any request will be met. Failure to meet any special request will not be a breach of contract on our part. We regret we cannot accept any conditional bookings, i.e. any booking which is specified to be conditional on the fulfillment of a particular request. All such bookings will be treated as "standard" bookings subject to the above provisions on special requests.

24. If you or any member of your party has any medical problem or disability that may affect your stay, please advise us prior to making your booking so that we can inform you as to the suitability of the chosen arrangements. In any event, you must give us full details in writing at the time of booking. If we reasonably feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline their reservation or, if full details are not given at the time of booking, cancel when we become aware of these details.

25. Please note, the information and prices shown on our web site may have changed by the time you come to book your stay. Whilst every effort is made to ensure the accuracy of the web site and prices at the time of requesting the booking, regrettably errors do occasionally occur. You must therefore ensure you check all details of your stay (including the price) on your booking acceptance.

26. It is your responsibility to ensure that you are in possession of all necessary travel and health documents (including Passports and Visas where applicable) before departure. You must pay all costs incurred in obtaining such documentation. If you or any member of your party is not a British citizen or holds a non-British passport, you must check passport and visa requirements with the Embassy or Consulate of the country to or through which you are intending to travel.

27. In the event of any problems you must contact us immediately, plus you undertake to do your best to resolve or minimise the problem in order to avoid any prejudices that could result. You must immediately get in touch with us by telephone on the day of your arrival, confirming your complaint in writing within 24 hours by fax or by e-mail. You are obliged to give us the time necessary to resolve the problem.

Should there be no complaint supplied specified as above and you leave the accommodation   prematurely and without an explicit authorisation by us, you forfeit your rights for a refund of the rental price, unless the terms of this contract have been breached. Complaints received at the end of the stay will not be taken into consideration and no refunds will be given.

28. Please note that the property is not an official tourist structure, such as a hotel, residences, etc. but a private dwelling. Being such, there is no standard or categories that are internationally recognized; indeed it reflects the architecture and furnishings, the local traditions and the personal taste of the owner. This is precisely the kind of holiday that we offer: the chance to partake in the culture of the area chosen, living for a few weeks in the same surroundings as an inhabitant would. We cannot however exclude the possibility that these differences can sometimes result in minor inconveniences - due to the special nature of its architecture and of traditions in the area - but which cannot be accepted as complaints.

Additional Terms and Conditions of Booking:

This contract is between the property owner and the lead guest who must sign the booking form accepting the conditions on behalf of all persons traveling. A contract exists when you have paid a deposit and we have accepted and confirmed your booking in writing. The lead guest accepts these conditions on behalf of all members of the party.

    • The person booking the holiday is responsible for his/her guests. No additional guests, other than those listed may be invited to stay without prior written agreement.
    • Provisional bookings may be held for up to 5 days pending receipt of your deposit and booking form.
    • Cancellation of a booking must be in writing and is subject to the following charges: more than 8 weeks - £150 deposit; less than 8 weeks - full payment.  In the unlikely event that the owners due to any circumstances beyond our control have to cancel your booking, the lead guest will receive a complete refund of all monies paid if no other mutually acceptable accommodation or dates can be arranged by the owner. The owner/ Management Company will not be liable for any other loss incurred by the clients.
    • Force majeure. The Owners/management Company of the property or their servants will not be liable for any loss or delay by any of the following. Strikes, riots, political unrest, hostilities, war or threat of war, terrorist activity, closure of airports or any other event beyond the owners control.
    • Until you have written confirmation that the booking has been accepted, the booking is not confirmed and no contract exists. Provisional bookings may be held for up to 5 days pending receipt of your deposit and booking form.
    • A refundable property guarantee of £150.00 is required at the time of booking; this will both secure the booking and will act as a guarantee to ensure that the property is left in the same condition as it is found. This will be fully refunded within 2 weeks of departure providing there is no damage, (after the property has been cleaned and the Management Company has received a status report). Full payment for the total rental cost is required 8 weeks prior to arrival. If on arrival you see anything is damaged or broken we ask that you report immediately if not it will be deducted from your deposit.
    • The complex has a swimming pool, which should be open most of the year, however the owners do not accept liability should it be closed or for injury however caused as a result of the pool or pool area. Guests are specially requested not to allow un-supervised children to use the pool area. Bands must be worn for the pool and will be provided for you.
    • The Golf Course should be available all year, however the owners do not accept liability should it be closed or for injury how ever caused. Guests are specially requested not to allow un-supervised children to use the golf area
    • We strongly recommend you to take out holiday insurance to protect your holiday arrangements. An EHIC (formerly E111) card can be obtained free online or get a form from the post office, for any medical treatment you many need whilst in Spain.
    • Your responsibility. The party must treat the property, its furnishings, fittings, utensils and other facilities with respect. Any loss or damage must be reported to the Management Company. The lead guest must make good or pay for the loss, damage or breakage. The owner reserves the right to withhold any monies from the security deposit to pay for any loss or damage caused to the property or its contents by any member of the party.
    • Problems. Any complaints relating to the property must be made in writing to the owner or Management Company within 24 hours of any problem arising. We will endeavor to put things right. Unless there is a valid reason, we will not consider the owner or representatives liable for any complaint that was not initially registered with our representative during your stay.
    • The lead guest is hereby made aware that on some estates in Roda there may be other homes/apartments under construction as there is on much of the Spanish Costa’s. The Owner/Management Company will not accept liability for any complaints arising from construction.
    • The Owner/Management Company will not be liable for any loss or delay caused by conditions over which they have no control. The owner/management will not be liable for any loss due to noise of disturbance from anywhere within the vicinity of the property.
    • Maximum number of guests—as per booking sheet if additional guest turn up they maybe turned away or charged for.
    • No pets.
    • For the comfort of future guests, we respectfully request that there is no smoking inside the property however you are permitted to smoke on the balcony or gardens
    • Law prohibits sub-letting, sharing or assigning.
    • Liability. The Owner/management Company do not accept any liability what so ever for death, personal injury, accidents, loss or damage to persons or personal effects however caused.
    • No items must be removed from the house; this includes linens and towels
    • You must leave the keys of the property immediately at the end of the holiday period to Sheryl or where agreed to leave it. Loss of key will be charged for at cost of key cutting plus a call out fee.
    •  Broken items must be replaced with one of similar value and appearance
    • The Tenant must not do anything which causes nuisance/annoyance, invalidates the Landlord’s insurance or is in any way illegal, immoral or damaging to the Property.
    • Please ensure all locks are used when leaving the property unattended
    • Please leave the BBQ as found and do not use liquid lighter on it.
    • Please observe the pool rule
    • do not take furniture down to the pool area you are welcome to use on grass area but please do not leave unattended or let other tenants use please always leave on terraced area when unattended it will be your responsibility if outside furniture is stolen.
    • Please do not dry laundry on the terrace an outside area is available off the master bedroom
    • Please ensure all kitchen area is as you found it and not to leave dirty crockery etc or you maybe have additional cleaning charges
    • Unnecessary call out to our property manager will be charged at 25 Euros.
    • The property has a combi boiler which by nature of the system water temp will vary if taps are used whilst running the shower please do not leave children unattended in the shower. If the system pressure drops the water will not heat please follow instruction in the utility room on how to re pressurise the system before calling Fiona out as unnecessary call outs will be charge at 25 Euros.
    • The property has air-conditioning throughout you will be provided with a complementary card which should be sufficient for your stay however additional cards can be provided by Fiona please ask on arrival or allow 1 working day for cards  to be dropped into you. Top up card will be charged for please ask Fiona for further details.
    • Wristbands for the swimming pool must be returned at the end of your stay any missing bands will be charge at £20 each.


    The Client agrees that payment of the rental deposit sum to the Owner will signify their full acceptance of these Terms and Conditions of Rental. The Client further acknowledges that by payment of the final rental sum, the Client has read and accepted these Terms of Conditions of Rental on this web site.
